Online reputation management in Spain

The right to be forgotten grew out of a Spanish case, and Spanish law adds its own tools on top of EU rules. We use them, together with platform rules and suppression, to remove what can come down and rebuild what people find when they search your name.

Why Spain gives you more than one route.

The right to be forgotten started with a Spanish case. In 2014, the Court of Justice of the European Union ruled on a case brought by a Spanish national whose name still brought up a 1998 newspaper notice about a property auction for old social security debts. The Court held that, in certain circumstances, a search engine can be obliged to remove links from the results shown for a person’s name, even when the original publication is lawful.

Spanish law builds on that. The Constitution protects the right to honor, Organic Law 3/2018 adds a specific right to have search engines remove links that are inaccurate, irrelevant, outdated or excessive, and the media must publish factual corrections in some cases. Not every result qualifies, and freedom of information still carries weight, so we check the grounds before we file anything.

Spain is one of our active service areas. We work with companies, executives, professionals and public figures who need page one to reflect who they are today, not what happened years ago.

The situations clients in Spain bring to us.

These are the problems that tend to shape a search result for a person or a brand in Spain.

Old news in online archives

A digitized article about a case, a debt or a dispute from years ago keeps ranking for your name. Depending on the facts, a right to be forgotten request may take it out of name searches.

Inaccurate press coverage

A story that gets the facts wrong can spread through other outlets and aggregators. A formal correction, publisher outreach and suppression each have a role.

Fake reviews and review attacks

A burst of fake or defamatory reviews can pull down the rating customers see first. We report reviews that break the platform’s rules through our content removal process.

Fake profiles using your image

Accounts that use your name or photos to mislead or humiliate you. We take down impersonation accounts through the platform’s own channels.

Forum threads and social posts

Accusations on Reddit, forums or social networks that rank for your name and get repeated. We start with the platform’s reporting channels and its notice process under EU law.

AI summaries repeating old claims

Google AI Overviews and assistants like ChatGPT can repeat an outdated story as current fact. We work on the sources they rely on, so the answer follows.

Platforms where we protect reputations

The Spanish and EU legal framework behind online reputation.

Spain combines its own laws on honor and data protection with EU rules that apply in every member state. This is general information, not legal advice.

Honor is protected by civil and criminal law

Article 18.1 of the Constitution guarantees the right to honor, personal and family privacy and one’s own image. Organic Law 1/1982 lets the affected person go to the civil courts, with a four-year limit, while the Criminal Code punishes calumnia and serious injuria, which prescribe after one year. [1] [2] [3]

The media must publish factual corrections

Under Organic Law 2/1984, a person or company mentioned in information they consider inaccurate and harmful can send a correction, limited to the facts, to the editor within seven calendar days of publication. The outlet must publish it free of charge and with similar prominence, generally within three days. [4]

The right to be forgotten and the GDPR

In Google Spain (C-131/12), the Court of Justice held that a search engine can be obliged to remove links from the results for a person’s name, subject to a balance with the public interest, which depends in particular on the person’s role in public life. Article 17 of the GDPR now sets out the right to erasure, with an exception for freedom of expression and information. [5] [6]

Spain adds specific rights for search engines and social networks

Organic Law 3/2018 gives a right to have search engines remove links found by searching a person’s name when the information is inaccurate, irrelevant, outdated or excessive (Article 93). It also gives a right to have data removed from social networks, which applies on simple request for content the person posted themselves (Article 94). [7]

The Digital Services Act sets a notice process

Since 17 February 2024, the EU Digital Services Act has required hosting services to offer an electronic mechanism to report specific content as illegal, with the exact URL and the reasons. They must decide in a timely, diligent and objective way, and online platforms must offer an internal complaints system against their decisions. [8]

How we work with clients in Spain.

A clear set of stages, fully transparent and confidential.

  1. 01

    Confidential assessment

Send us what ranks for your name. We map page one, check each result against the delisting, correction and platform routes and answer within one business day.

  2. 02

    Written plan

You get a written audit within two business days: what can be delisted or removed, through which route and what needs suppression instead.

  3. 03

    Removal and delisting

We file the requests that have real grounds: GDPR requests to search engines and publishers, platform reports and legal channels where they fit. In parallel, we build accurate content to outrank what stays.

  4. 04

    Monitoring

We track page one every week and react the moment a result moves, so the gains hold.

Questions about reputation management in Spain.

Cannot find what you are looking for? Send us your question and we answer within one business day.

Send your question
How much does online reputation management cost in Spain?

It depends on what ranks, how many results are involved and which routes apply. For content removal, you are billed only when the URL is verified offline. For ongoing reputation management, the first month is contingent on the strategy we deliver in week one: if you do not see the path forward, you do not pay.

Can I use the right to be forgotten to remove news about me?

In some cases. A delisting request can take an article out of the results for your name when the information is inaccurate, irrelevant, outdated or excessive, but the article itself can stay online. The request is weighed against the public’s interest in the information, which can depend on your role in public life, so public figures may find it harder.

Can I make a newspaper correct an article?

If the article contains facts you consider inaccurate and harmful, Spanish law lets you send a factual correction to the editor within seven calendar days of publication. After that window, publisher outreach, delisting and suppression are the usual routes.

Is defamation a crime in Spain?

It can be. The Criminal Code punishes calumnia and serious injuria, and the affected person can also bring a civil claim under Organic Law 1/1982. A legal claim is one option among several.

How long does it take to see results?

It depends on the route. Search engines and platforms decide on requests at their own pace, and suppression builds over time: many results move within a few months, while deeply entrenched content takes longer. Your written plan sets out realistic timelines before any work begins.

Is the work confidential?

Yes. Every client signs an NDA, and so do we. Case studies are published only with the client’s consent and permission.
